What happened

In a landmark move, the Consumer Financial Protection Bureau has issued guidance that certain MCA products with fixed payment schedules should be classified as loans under federal law.

Moneyline confirmed the details with 1 people with direct knowledge, who asked not to be named because the matter is not yet public. This story on CFPB is developing; we will update it as filings and statements land.

Why it matters

For brokers, the immediate question is exposure: open submissions, pending renewals and any residuals tied to the originator's book. For funders, it is contagion — syndication partners, shared merchants and the credit lines that finance them. Moneyline's data desk estimates that roughly one in six active brokers has submitted a file to the affected shop in the past 90 days.

The numbers behind it

The figures below come from Moneyline's data desk, drawn from verified member submissions and public filings. They are directional, not audited — but they are the clearest picture available today.

What we're hearing

In #news-desk and across three funder councils, the early read is less surprise than resignation. Several members said pricing and paper quality had drifted for months. Two ISOs told Moneyline they had already paused submissions in the spring.

“Everyone saw the paper they were buying. Nobody wanted to be the first to stop sending them deals.”

  2. How quickly competing funders move to absorb the broker network
  3. Any regulatory response from state AGs where the originator was licensed

We had 14 deals in their pipeline. Already re-papering the renewals with two other shops — anyone know if the syndication partners are being made whole?

Called this in Q2. When a funder starts buying paper at 1.49 factor to hit volume, the clock is ticking.

Sharing this with the team. The newsletter version was good but the full piece has the numbers we needed.
